What Is Tip Pooling?

In California, service workers traditionally receive tips. California Labor Law 351 states that these tips belong to the employee alone. For many service workers, tips are a significant part of their income, often exceeding their regular wages. Common tip recipients include waitstaff, hosts, valets, bartenders, cleaning staff, movers, delivery workers, dancers, spa and salon staff, and event planners.

Tip pooling involves collecting tips from individual service employees and distributing them among a wider group. Fair and reasonable distribution of these tips is crucial. A formula, based on the business's tip pooling policy, dictates this distribution. 

Establishments adopt tip pooling to:

California’s Tip Pooling Laws

Eligibility for Tip Pools

Only employees are qualified for tip pools. Managers, supervisors, owners, or anyone who can hire, fire, or direct work duties are not allowed to take part.

Ownership of Tips

Tips must originate from customers and go directly to employees. Tip pools must distribute these customer-given tips only among eligible staff. 

Limits on Tip Contributions

An employer cannot demand excessively high contributions to a tip pool. The cut an employee contributes should align with what's typical and reasonable.

Income vs. Wages

Tips belong to the employee who receives them and are distinct from wages. They still count as taxable income, but they do not impact the minimum wage requirement. As of 2023, the minimum wage in California is $15.50 per hour.

Prohibition of 'Tip Credit'

Employers may not reduce hourly wages because of the tips an employee receives. This practice, called 'tip credit,' is illegal in California.

Cash Tips and Payment Processing

Employees should collect cash tips straight away. For credit or debit card tips, employees should receive the full amount by the next payday without any deductions for processing fees.

Employer Responsibilities

Employers must track all tips and ensure the California Labor Commissioner can access these records.
